Version 1.0, dated 5 November 2026.
The Spanish version prevails.
1. Parties and definitions
These terms govern the use of Mecanius. The service is provided by MECANOVA LAB SpA, Chilean tax ID (RUT) 78.541.649-K, domiciled at office No. 302 of the Centro de Negocios Uribe building, located at Uribe Street No. 636, commune of Antofagasta, Chile, contact contacto@mecanova.cl. It is hereinafter referred to as “Mecanius”.
- “Service”: the Mecanius finite element analysis platform and its web interface. It runs on servers managed by Mecanius.
- “Desktop Program”: the Windows application that connects to the Service. It can also open, offline, projects saved as .mecx files.
- “Customer”: the natural person or legal entity that subscribes to a Plan.
- “User”: each person with an account, whether the Customer or someone authorized by the Customer.
- “User Content”: what the User uploads or generates: models, files, load cases, settings, results and reports.
- “Vysia AI”: Mecanius’s own assistant, which runs on the Service’s servers. It interprets the instructions the User writes and proposes how to set up each simulation: loads, supports and mesh.
- “Plan”: the subscription tier (Pro or Prime), with its limits. A Prime Plan is either commercial or academic (section 4).
2. Acceptance and versions
The User accepts these terms and the Privacy Policy by expressly indicating so at any of these moments:
- in the Desktop Program installer, by clicking “I Agree”;
- when activating their account or signing in to the Service, when asked, by checking “I have read and accept the Terms of Use and the Privacy Policy”;
- when subscribing on the website, by checking the acceptance box.
Silence or merely visiting the website does not constitute acceptance.
- Before subscribing, these terms are available through a visible link and can be downloaded or printed.
- After subscribing, Mecanius sends a copy to the account’s email address.
- Each version has a number and a date. Mecanius records which version each User accepted and when.
- Representation: anyone acting on behalf of a company represents that they have the authority to bind it.
- Minimum age: the Service is intended for professional use and requires being at least 18 years old.
3. Accounts and access
- Personal account: each account is personal and non-transferable, and is accessed with an email address and a password.
- The User chooses the password through a single-use activation link. Mecanius does not know it and never sends it. If the User forgets it, “Forgot your password?” sends a single-use link to the account’s email address to choose a new one.
- Second factor: the account may require, in addition to the password, a 6-digit code from an authenticator app on a mobile phone. It is mandatory for administrator accounts and optional for the others; the User’s institution or company may require it. If the User loses the phone and their backup codes, Mecanius removes the second factor only after verifying their identity.
- Confidentiality: the User must keep their password and backup codes confidential and report any unauthorized use immediately to soporte@mecanova.cl.
- Sessions: each account allows up to 2 simultaneous sessions; if another one is opened, the oldest one is closed. The session ends when the program or the browser is closed.
- Staff accounts: the Customer may request accounts for its staff, within the limits of its Plan, and is responsible for their use. In a Prime Plan, the administrators designated by the Customer create and remove those accounts from “My account”, never exceeding the licenses contracted, and may set an end date for them and require the second factor. The Customer is also responsible for whom it registers and for having the authorization to provide Mecanius with the name and email address of each user.
4. License to use
Mecanius grants the Customer and its Users a limited, non-exclusive, non-transferable and revocable license. It allows use of the Service and the Desktop Program while the subscription is active, in the Customer’s professional and commercial activity, including the engineering services the Customer provides to its own clients.
Academic license: in an academic Prime Plan, the license allows use of the Service only for the institution’s teaching, research and publications, and does not authorize commercial use. The “Authorized use” sheet of its reports says so, with the name of the institution and the license type “Academic (commercial use not authorized)”, and so does its verification, which shows “Academic use (commercial use is not authorized)”.
The following is not permitted:
- copying, modifying, decompiling, disassembling or reverse engineering the Service or the Desktop Program, except as expressly permitted by law;
- circumventing the security measures, the Plan limits or the signature verification of results;
- reselling, sublicensing or giving third parties access to the Service or to an account (selling reports and results is permitted: see section 5);
- using the Service to develop a competing product;
- using bots or automated loads that impair the service for other users.
The Desktop Program may be installed on the Customer’s computers. Without an active account, it only opens saved projects (.mecx) for viewing.
Authorized use sheet: every report ends with a sheet certifying that it was calculated with Mecanius under a valid license. All Plans include it. It shows the license holder, the license number and the Plan, the program version, the document and its revision, the date of issue and, in the official report, a verification code with its QR code, which anyone can check on the Mecanius verification page. The sheet and the verification certify the authorized use and the origin of the results; they do not certify that the report is correct (section 6). The sheet may not be altered or placed in documents that were not calculated with Mecanius. Mecanius may void the code of a report issued fraudulently or in breach of these terms. Every voiding, whether by the license holder or by Mecanius, remains visible in the verification with its reason, and the license holder is notified by email and, if the report was issued under an institution’s license, so are its administrators.
5. The content belongs to the User
- Ownership: User Content belongs to the User or to the Customer. Mecanius acquires no ownership rights over it.
- Commercial use of the results: the User may use, sign, deliver and sell to their clients the results, calculation reports and other reports they generate with the Service, without paying any additional fees to Mecanius, except under an academic license, which does not authorize commercial use. What no license allows is giving third parties access to the Service or to the account (section 4).
- Limited permission: the User grants Mecanius only the permission needed to store, process and display that content for the sole purpose of providing the Service: calculating, generating results and reports, and keeping each project while it is being worked on.
- What Mecanius never does:
- sell User Content;
- share it with third parties;
- use it for purposes other than the Service;
- use it to train models that serve other users: what Vysia AI learns belongs to each account (see the Privacy Policy).
- Who may see it:
- the User;
- the people the Customer authorizes;
- when essential for technical support or security, Mecanius staff with the User’s prior authorization. Whenever staff read or change an account’s data with the Mecanius administration tools, it is logged with who did it, when, what they did and why, and the User receives that log in “Download my data”.
- Right to use what is uploaded: the User represents that they have the right to use the files, models and data they upload, including those that come from third parties, from their employer or from other programs. Mecanius does not review the origin of those files and is not liable for it or for any rights that third parties may have over them.
- Where the work is kept: the User’s work is kept in their .mecx files, on their computer. The Service uses each project only while it is being worked on: it deletes it from the server when the User leaves with “Sign out” or after 24 hours without use, never while a calculation is in progress. With “Download my data”, on the user card (“Your data” section), the User can also download all of their account data.
6. The results are a support tool
Mecanius calculates using the finite element method. It starts from the models, materials, loads, constraints and meshes defined by the User, with or without the help of Vysia AI.
- They are approximations: the results are numerical, and their accuracy depends on the input data and on the assumptions of the model.
- The User reviews before calculating: the User must review what Vysia AI proposes and confirm every area marked “Not sure”.
- They do not replace a professional: the results, safety factors and reports do not replace the judgment of a competent professional or the review required by the applicable standards.
- Decisions belong to the User: designing, manufacturing, building or approving a structure or a piece of equipment is the exclusive decision of the User and of the responsible professionals.
- Reports are the User’s responsibility: the content of each report (input data, assumptions, results included, interpretation and conclusions) and its use are the sole responsibility of the User and of the professional who signs it. Mecanius does not review, approve or certify designs or reports, and is not a party to the contracts between the User and their clients.
- Materials: the values in the library are minimum values from standards, for information only. The User must confirm the values of the material they actually work with.
- Signed results and verification code: the Service signs every calculation, and every official report carries a verification code. Both prove that the results came from Mecanius under a valid license and were not modified; they do not prove that the model, the assumptions, the design or the conclusions are correct.
7. Plans, payments, renewal and withdrawal
- Before subscribing, the Plans, their final prices including taxes and their limits (for example, calculation minutes) are published on the Mecanius website (www.mecanius.com).
- Payments: are processed through Flow (flow.cl). Mecanius does not receive or store card details.
- Renewal: the subscription renews automatically for monthly or annual periods, depending on the Plan, until the Customer cancels it.
- Cancellation: takes effect at the end of the paid period.
- Withdrawal: before payment, it is clearly stated whether a person contracting as a consumer may withdraw and within what period, under Article 3 bis of Law No. 19,496.
- Price changes: are announced at least 30 days in advance.
- Failed payment: Mecanius may suspend access if the payment is not settled within 10 days of the email notice. The account data is kept for 30 days after the suspension.
8. Availability, support and acceptable use
- Availability: Mecanius strives to keep the Service continuously available. There may be interruptions for maintenance, announced in advance whenever possible, due to provider failures or due to force majeure.
- Calculation priority: calculations wait their turn in a queue. In Mecanius Cloud, those of commercial Plans go before those of academic Plans, and an institution’s contract may set how many of its calculations run at the same time.
- Connection outages: an outage does not delete the open project. The program warns the User and allows saving it when the connection returns. Saving projects is the User’s responsibility: before signing out, if there are changes or results that are not in their .mecx file, the program warns them, and whatever is not saved is lost when the Service deletes the project from the server (section 5).
- Space on the server: each account has a maximum amount of space on the server, to prevent abuse. Once it is reached, the Service does not accept anything new until space is freed, and nothing is deleted automatically because of it.
- Support: soporte@mecanova.cl, Monday to Friday, 9:00-18:00.
- Acceptable use. The following is not permitted:
- uploading unlawful or malicious content;
- trying to access other people’s accounts or data;
- deliberately overloading the Service;
- using it for illegal purposes.
9. Intellectual property
- Mecanius’s property: the Mecanius program, its code, Vysia AI, the interface, the brand, the logos and the documentation belong to MECANOVA LAB SpA and are protected by law.
- Third-party components: the Service and the Desktop Program include open-source components governed by their own licenses. The list is in “Third-party licenses”, in the program and on the website. Nothing in these terms limits the rights granted by those licenses.
- Suggestions: Mecanius may freely use the ideas the User proposes to improve the product. This does not include User Content.
10. Liability, suspension and termination
- Liability: to the fullest extent permitted by law, Mecanius is not liable for indirect damages, for loss of profits, for design decisions made on the basis of the results or for the content or use of the User’s reports (section 6).
- Its total liability is limited to the direct damages caused by a failure of the Service attributable to it.
- If a client of the User or another third party makes a claim against Mecanius regarding a report, a design or a file of the User, the User is liable and holds Mecanius harmless, unless the damage results from a failure of the Service attributable to Mecanius.
- None of this limits the consumer’s non-waivable rights or liability for willful misconduct (dolo) or gross negligence (culpa grave).
- Suspension: Mecanius may suspend an account that breaches these terms or endangers security. It will give notice beforehand, except in urgent cases.
- Termination: the Customer may terminate at any time by cancelling their subscription.
- Upon termination, the Customer’s projects remain in their .mecx files, and they may download the rest of their account data for 30 days.
- After that, that data is deleted from the Service, except for the record of issued reports and what the law requires to be kept.
- In a Prime Plan of an institution or company, if its contract is suspended, none of its accounts can sign in, but nothing is deleted. If it expires, its accounts are kept for 12 months without being able to sign in: if it is renewed within that period, everything works again as before; after that they are closed, with a notice to its administrators 30 days before. The record of the reports issued with them is always kept.
- Account closure: the User may close their account at any time with “Close my account”, on the user card (“Your data” section). Whatever remains of their projects on the server is deleted immediately and the rest of the account data 30 days later, as explained in the Privacy Policy. The record of their issued reports is kept so that they can still be verified, with their data while the report is valid. To withdraw their data from a report, the User voids it and checks “Also withdraw my data from this report”; when closing the account, they may withdraw it from their voided reports.
11. Changes, governing law and communications
- Changes: Mecanius may modify these terms.
- It will give 30 days’ notice, by email and within the program.
- It will ask Users to accept the new version when they sign in.
- If the Customer does not accept it, the Customer may cancel at no cost.
- Governing law: these terms are governed by the laws of the Republic of Chile. Anyone who contracts as a consumer retains the right to file a claim with Sernac (the Chilean National Consumer Service) and with the local police court (juzgado de policía local) that corresponds to them. Disputes with anyone who does not contract as a consumer are submitted to the ordinary courts of Antofagasta, and anyone contracting from another country retains the non-waivable rights granted by their law.
- Communications: are sent to the account’s email address and to soporte@mecanova.cl. Mecanius’s automatic emails come from soporte@mecanova.cl, and Mecanius never asks by email for the password or the second-factor codes.
- Language: if these terms are published in several languages, the Spanish version prevails.
